Event Waiver

By purchasing tickets to a Secret Garden Society event, you accept this waiver for yourself and for every guest on your order, and you confirm that you have shared it with them. Guests under 18 must attend with a parent or legal guardian, and the parent or guardian accepts this waiver on the minor's behalf by attending. Assumption of Risk

Secret Garden Society events may take place at our farm or at the spaces of our partners, hosts, and venues, including restaurants and bars. I understand that attending and taking part carries risks that cannot be fully eliminated, including but not limited to:

The venue: uneven or unfamiliar surfaces, wet or crowded floors, steps, chairs, tables, cords, glassware, and hot food, and the conduct of other guests and patrons.

Tools and materials: scissors, snips, floral knives, stems, thorns, water, and containers, and the cuts, punctures, and scrapes that can come from them.

Plants: pollen, sap, and plants that may cause allergic reaction, rash, or irritation on contact or illness if eaten.

Food and drink: allergic reactions to food or drink, and the effects of alcohol.

Getting there: parking and walking to and from the venue, and exposure to communicable illness.

I am participating voluntarily and with full knowledge of these risks, and I assume all of them, known and unknown, including those arising from my own negligence or inattention.

Release of Liability

In exchange for being permitted to attend and participate, I, for myself and for my heirs, family, executors, administrators, and assigns, release, waive, and discharge Secret Garden Society, its owners, members, employees, volunteers, instructors, contractors, and vendors, and any partner, host, sponsor, or venue at or with which a Secret Garden Society event takes place, together with their respective owners, landlords, employees, and staff, and the owners and residents of any property where an event takes place (together, the "Released Parties") from any and all claims, demands, damages, costs, and causes of action of any kind for injury, illness, death, or loss of or damage to property, arising out of or relating to my attendance or participation, to the fullest extent permitted by Oregon law.

I understand this release covers claims based on ordinary negligence by the Released Parties. It does not cover, and I am not being asked to release, claims that Oregon law does not permit to be released, including gross negligence, recklessness, willful or wanton misconduct, intentional acts, or any other claim made non-waivable by statute.

I understand this is a release of legal rights, that it is binding on me, and that I am agreeing to it freely and without inducement.

Alcoholic Beverages

When alcoholic drinks are offered at an event, they are served by the host or venue under its own liquor license, and Secret Garden Society does not serve alcohol. I will only order an alcoholic drink if I am 21 or older, and I will show valid ID when asked. I understand the staff may refuse service at any time. I am responsible for my own drinking and for getting home safely, and I will not drive if I am impaired.

Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any claim, loss, liability, damage, or expense, including reasonable attorney fees, that is brought by me or on my behalf, or that arises from my own acts or omissions, or from the acts of any guest, minor, or animal in my care while on or near the property.

Flowers, Plants and Products

Flowers are decorative, not food. Many ornamental and cut-flower plants are toxic to people and to animals if eaten, chewed, brushed against, or handled, and the water in a vase holding cut flowers can also be toxic. Plants grown here may include, among others, foxglove, delphinium and larkspur, monkshood, lily, hellebore, ranunculus, anemone, sweet pea, daffodil, tulip, hydrangea, euphorbia, and members of the nightshade family. Lilies in particular are lethal to cats even in very small amounts, including pollen and vase water.

Any cut flowers, bouquets, arrangements, plants, seeds, bulbs, or other goods I receive or purchase from Secret Garden Society are provided strictly as ornamental and decorative items. They are not food, are not tested or intended for consumption, and are not safe for people, pets, or livestock to eat.

I accept sole responsibility for keeping flowers, plants, and vase water out of the reach of children, pets, and animals, both at the event and after I take them home. I release the Released Parties from any claim arising from illness, injury, or death to any person or animal resulting from contact with, or ingestion of, any plant, flower, or product from Secret Garden Society.

Emergency Medical Care

If I am injured or become ill, I authorize Secret Garden Society to call emergency services and to arrange first aid or medical treatment on my behalf. I accept financial responsibility for any medical care I receive, and I confirm I am responsible for my own health insurance. I understand Secret Garden Society does not provide medical insurance or accident coverage for guests.

Photos and Video

We sometimes take photos and video at events for our website and social media. If you would prefer not to appear in them, tell a member of our team at the event and we will happily leave you out.

General Terms

If any provision of this agreement is found unenforceable, the remaining provisions stay in full force. This agreement is governed by the laws of the State of Oregon.
